Terms of Service

1. Acceptance of Terms

By using the Heymish app ("the App", "the Service"), operated by Satori-Advisory, a registered business (עוסק מורשה) in Israel ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. We reserve the right to update these Terms from time to time. Material changes will be communicated through the app or via email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms.

2. Service Description

Heymish is a social game for couples and friends. The Service allows users to ask and answer questions across various categories (daily, intimate, sexy, funny), earn scores, and build game streaks. The Service also includes chat between players and a badge system.

3. Eligibility and User Accounts

• You must be at least 16 years old to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials, including your password.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and up-to-date information when registering and update it as needed.
• You may only maintain one account. Creating multiple accounts may result in suspension.

4. User Conduct

When using the Service, you agree not to:

• Post offensive, threatening, racist, or illegal content.
• Share sexually explicit content outside of the designated "sexy" category context, or share content that depicts minors in any sexual context.
• Harass, intimidate, or harm other users.
• Use the Service for unlawful or unauthorized purposes.
• Attempt to access systems or data not intended for you.
• Violate other users' privacy or share their answers without their consent.
• Use bots, scripts, or other automated tools to access the Service.
• Impersonate another person or misrepresent your identity.

5. User Content

Content you create in the Service (answers, chat messages, personal questions) remains yours. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to store, display, and process this content as necessary to operate and improve the Service. This includes the right to use aggregated, anonymized data derived from user content for analytics and service improvement. We reserve the right to remove content that violates these Terms without prior notice.

6. Content Moderation

We are not obligated to monitor user-generated content but reserve the right to review, moderate, and remove content at our sole discretion. We may use automated systems and manual review to enforce these Terms. If you encounter content that violates these Terms, please report it to us using the in-app reporting tools or by contacting us at the email listed below.

7. Intellectual Property

All rights in the App, including its design, logo, original questions, code, and content, belong to Satori-Advisory or our licensors. You may not copy, reproduce, distribute, or create derivative works from the Service without prior written permission.

8. Third-Party Platforms

The App is available through the Apple App Store and Google Play Store. Your use of those platforms is subject to their respective terms and conditions. Nothing in these Terms shall modify or supersede any terms imposed by Apple or Google regarding the use of their platforms.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be available continuously, error-free, or completely secure. In no event shall we be liable for any indirect, special, consequential, or punitive damages arising from the use of the Service. Our total cumulative liability for any claims arising under these Terms shall not exceed the amounts you paid to us, if any, in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or willful misconduct.

10. Disclaimer Regarding User Interactions

We are not responsible for content posted by users in the Service, including answers to questions and chat messages. Interactions between users are their sole responsibility. We encourage all users to act with care and mutual respect. If you experience harmful behavior from another user, please report it through the app or contact us directly.

11. Suspension and Termination

We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms or acted in a way that harms the Service or other users. Where feasible, we will provide notice of suspension and the reason for it. You may delete your account at any time through the app settings.

Upon termination or account deletion, we will delete your personal data in accordance with our Privacy Policy. You may request a copy of your data before deleting your account by contacting us.

12. Dispute Resolution

If a dispute arises from these Terms or the use of the Service, we encourage you to first contact us at the email below to attempt an informal resolution. We will endeavor to respond within 14 days. If the dispute cannot be resolved informally within 30 days, either party may pursue formal legal proceedings.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Israel, without regard to conflict of law principles. Any dispute that cannot be resolved through the informal process described above shall be submitted to the exclusive jurisdiction of the competent courts of the Tel Aviv-Jaffa district, Israel.

14. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, labor disputes, government actions, internet or infrastructure failures, or third-party service outages.

15. General Provisions

• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
• No waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
